Sale Period : Tax deed sales are held whenever properties become available. There is no set schedule for public auction sales; sales are set as research and field checks are completed in each county.

For information as to when a sale may be conducted in a given county that is not listed on the New Mexico Current Sale Schedule, please refer to the Tentative Sale Schedule or contact the New Mexico Property Tax Division office.

Properties are auctioned at the county seat (courthouse) or at such place as is designated by the Department, in the county where the properties are located.

Redemption Period: No extended right of redemption following the tax deed sale.

Legal Challenge Period: There is a two-year period allowed in which the former owner has the right to challenge the sale through court.

Bidding Process: Bidders must be physically present or be represented by an agent. In the event an agent is representing a bidder, the agent must present to the Property Tax Division, prior to the sale, a document authorizing him to act as an agent for the party he will represent.

The maximum bid is based upon the amount of taxes, penalty, interest, and fees, as well as consideration given for the owner’s interest.

State-Specific Information: There are 32 counties in New Mexico. Tax lien certificates are not offered to the public or acquired by the counties. Tax deed auctions are conducted by the Department of Revenue and Taxation of the State of New Mexico. These sales are conducted at varying times during the year. During almost every month there is one or more tax sale in this state. Some counties have 3, 4, or even 5 sales per year. The minimum bid is set by the Department of Taxation and Revenue, but is normally less than 10% of the fair market value of the property.
